Terms and Conditions - Art House Residence

I. General Provisions

These Terms and Conditions outline the conditions under which reservations and rental of accommodation at Art House Residence can be made. Making a reservation implies acceptance of these Terms and Conditions. The agreement between the Client and the Landlord is concluded upon making a reservation online, via email, or by phone.

II. Reservation

1. To make a reservation, the Client books a stay for the selected period. A preliminary reservation confirmation will be sent to the Client's email address. In the absence of confirmation of the full deposit payment within the specified timeframe, the Landlord reserves the right to cancel the reservation.

2. The booking confirmation sent by the intermediary shall include:

a) the date of the Client's stay

b) the amount due for the rental

c) information regarding the deposit amount

d) bank account details

e) general reservation conditions

3. Upon receiving the reservation payment, the Client will receive a confirmation email.

4. The deposit, as defined, is non-refundable according to Article 394 of the Civil Code.

5. If the deposit amount does not cover the full reservation cost, the Client is obliged to pay the remaining amount within the timeframe specified in the reservation confirmation.

III. Rental Agreement Conditions

1. Renting the Residence includes all utility fees, disposable items provided (cleaning supplies, toiletries), and general services available to Guests of the facility.

2. Stay:

- starts at 4:00 PM on the day of arrival and ends at 11:00 AM on the day of departure.

a) Early check-in on the arrival day is dependent on current occupancy and is considered individually by the Landlord. Despite the Landlord's best efforts, early check-in is not guaranteed in advance. To secure early check-in, an individually agreed fee must be paid.

b) Extending the stay is dependent on current occupancy and is considered individually by the Landlord. Despite the Landlord's best efforts, extending the stay is not guaranteed in advance. To secure a late check-out, an individually agreed fee must be paid.

c) Art House Residence provides services in accordance with its category and standard. If there are any concerns regarding service quality, Guests are asked to report them immediately to the Landlord.

3. The Client must promptly notify the Landlord of any incidents that may cause material damage to the property or endanger the safety of other Guests on the premises.

4. The Client may use the residence solely for residential purposes and may not sublet it.

5. A security deposit in the amount specified in the reservation confirmation is collected upon check-in, to cover potential damages. It is refunded on the day of departure after checking the condition of the residence.

6. Art House Residence and the owner are not responsible for the improper use of equipment included in the residence, resulting in injury or loss of life of the Guest.

7. A child under three years old, sleeping with adults or in their own crib and not requiring bedding, stays free of charge. Other children are charged according to the reservation conditions.

8. The reservation includes a free parking space near the building in a designated and marked area, as well as a garage space in the building. The management is not responsible for damage to or loss of the car or other vehicle left in front of the building or in the garage.

9. Check-in after 9:00 PM and check-out before 7:00 AM, requiring the presence of the Manager, should be reported and arranged in advance. The Manager's arrival/departure between 9:00 PM and 7:00 AM incurs an additional fee of 100 PLN.

IV. Client Obligations

The actual number of people staying in the residence is limited to the number specified in the reservation confirmation. The Client is obliged to inform the Landlord of any changes in the number of people staying in the rented residence. If the residence is used contrary to the reservation conditions, the Landlord may refuse accommodation. In such a case, the Client is obliged to pay the full reservation amount.

2. The Client must notify the Landlord of any additional persons before they stay. The Landlord reserves the right to refuse additional persons if their total number exceeds the residence's capacity. Additional persons will be charged according to the agreement between the Client and the Landlord.

3. The Client is obliged to maintain good neighbourly relations.

4. The Client and their Guests are responsible for any damage they cause in the rented residence, common areas, and on the property. They must promptly report any damage to the Landlord and cover the costs.

5. The Client and their Guests are responsible for all clothing, personal items, and money brought with them. Clothing and personal items left behind by the departing Guest can be sent back at their expense, to an address they specify.

6. Smoking of tobacco products, IQOS, electronic cigarettes, etc., is prohibited throughout the facility. Violating the smoking ban incurs a fee of 1000 PLN. If the fire brigade is called, the Guest will be charged an additional fee.

7. Walking in ski boots is prohibited on the premises. Skis and ski boots must be left in the designated area.

8. The Client must return all keys received during their stay. Failure to return or loss of keys will incur a charge of 500 PLN.

9. The Guest must dispose of their rubbish in the designated area before checking out. Failure to do so incurs a fee of 500 PLN.

10. The residence must be left clean – dishes, cutlery, pots, refrigerator, and dishwasher must be cleaned and emptied. Failure to do so incurs an additional cleaning fee of 500 PLN.

11. The Guest must present a photo ID to the Landlord upon request. Refusal to show the ID may result in the Landlord denying accommodation.

12. Organising events without prior consent from the owner is prohibited.

13. Minors (children) cannot stay in the residence without adult supervision.

14. If the reservation is cancelled no later than 30 days before the start of the stay, the deposit can be used for another stay within the current year, subject to price conditions for the new stay period. If the reservation is cancelled less than 30 days before the start of the stay or if the Guest does not show up, the deposit is forfeited.

VI. Reservation Changes

1. Reservation modifications after booking are only possible through individual agreement with the Landlord. Confirmation of reservation modifications is provided via email.

VII. Transfer of Client Rights and Obligations to Another Person

1. The Client may transfer all their reservation rights to another person, provided that the person also assumes all obligations. The Landlord must be promptly informed of the change, including personal and payment details of the new Client. The person taking over the reservation must confirm this via email.

VIII. Force Majeure

1. The parties may be exempt from liability for non-performance or improper performance of the agreement due to force majeure.

2. For the purposes of this agreement, "force majeure" means any event beyond the control of the parties, which could not be anticipated at the time of the agreement and could not be prevented, including natural disasters, state of emergency, war, new legislation or administrative decisions, technical failures affecting the agreement, and similar events. The party invoking force majeure must immediately notify the other party in writing.

IX. Governing Law

1. The governing law for disputes between the owner and the Client is Polish law. Disputes will be resolved by the court competent for the company's registered office at Krupówki 37, Maja Czmielewska.

X. Personal Data Processing and Protection

1. We inform you that the data from reservations will be processed by Art House Residence as the administrator for check-in purposes, legal obligations (including tax), and to secure legitimate interests in claiming potential property and non-property claims and defending against claims from others.

You have the right to access, rectify, delete, or restrict the processing of your data, the right to object to processing, and the right to data portability. Providing data is necessary for reservation purposes. Without it, check-in cannot be completed. You have the right to lodge a complaint with the President of the Personal Data Protection Office (ul. Stawki 2, 00-193 Warsaw).

According to Article 7a of the Act of May 30, 2014, on consumer rights, Krupówki 37 Maja Czmielewska is obliged to respond to complaints within 30 days of receipt.
